    What Is Trademark Registration?

    Trademark registration is the legal process of protecting a brand name, logo, symbol, word, slogan, or design that distinguishes your goods or services from everyone else's. It's governed by the Trade Marks Act, 1999, and administered by the Controller General of Patents, Designs and Trademarks (CGPDTM) through the IP India portal.

    Word Mark vs Logo — which should you register first? If your budget allows only one filing, register the word mark first — it protects your brand name in any font, colour or visual presentation. A device mark (logo) protects only that specific visual design. Businesses with both a distinct name and logo should ideally register both separately for full coverage.

    Handling Objections and Opposition

    Trademark Objection

    The Registrar may object to your application under Section 9 (absolute grounds — the mark is generic or lacks distinctiveness) or Section 11 (relative grounds — conflict with an existing mark). You have 30 days to respond with legal arguments and supporting evidence; persistent objections may require a hearing before the Registrar.

    Trademark Opposition

    After journal publication, any third party has 4 months to oppose your mark if they believe it conflicts with their rights. You must file a counter-statement within 2 months of receiving the opposition notice, after which both sides submit evidence and the Registrar decides.
