What Is Trademark Registration?
Trademark registration is the legal process of protecting a brand name, logo, symbol, word, slogan, or design that distinguishes your goods or services from everyone else's. It's governed by the Trade Marks Act, 1999, and administered by the Controller General of Patents, Designs and Trademarks (CGPDTM) through the IP India portal.
Once registered, you hold exclusive rights to use the mark in commerce, can take legal action against infringers, and are entitled to use the ® symbol. Registration is valid for 10 years and can be renewed indefinitely, giving your brand long-term, enforceable protection.
™ vs ® — what's the difference: the ™ symbol can be used the moment you file your application — it signals that you claim the mark as yours, registered or not. The ® symbol can only be used once registration is complete and confirms full legal protection under the Trade Marks Act. Using ® before actual registration is an offence.
What is a trademark? A trademark is a unique word, name, symbol, logo, phrase, design, sound or colour combination that identifies and distinguishes your goods or services in the marketplace. It's your brand identity — the thing customers recognise and trust.
Who Can Apply?
- Individuals — freelancers, entrepreneurs, brand owners
- Sole proprietorship firms — registered in the proprietor's name
- Partnership firms — registered in the firm's name, including all partners
- Private/Public Limited Companies — registered in the company name
- LLPs — registered in the LLP's name
- Trusts, societies and NGOs
- Foreign applicants — through a local trademark agent in India
Benefits of Trademark Registration
Exclusive Rights & Legal Protection
Registration gives you legal exclusivity over your mark for your registered goods and services, preventing competitors from using anything confusingly similar.
Brand Recognition
A protected trademark builds trust and recall — customers learn to associate the mark with your quality and reputation.
A Business Asset
A registered trademark is intellectual property. It can be licensed, assigned or sold, creating an additional revenue stream.
Right to Sue Infringers
You can take legal action against anyone who copies or misuses your mark, and claim injunctions, damages or compensation.
International Expansion
A registered Indian trademark makes it easier to file for protection abroad, including through the Madrid Protocol covering 130+ countries.
Types of Trademarks You Can Register
Word Mark
Protects a business name, product name or slogan, regardless of font or style.
Device Mark (Logo)
Protects a graphical or artistic representation of your brand.
Combination Mark
Protects a name and logo together, as used in combination.
Collective Mark
Used by members of an association, indicating membership.
Certification Mark
Certifies that goods or services meet a defined standard.
Shape Mark
Protects a distinctive product or packaging shape.
Pattern Mark
Protects a unique, identifiable pattern used on goods or packaging.
Sound Mark
Protects a distinctive jingle or audio signature.
Colour Mark
Protects a specific colour or colour combination uniquely tied to a brand.
Word Mark vs Logo — which should you register first? If your budget allows only one filing, register the word mark first — it protects your brand name in any font, colour or visual presentation. A device mark (logo) protects only that specific visual design. Businesses with both a distinct name and logo should ideally register both separately for full coverage.
Choosing the Right Trademark Class
India follows the Nice Classification system — 45 classes covering all goods and services. Classes 1–34 cover goods (chemicals, clothing, electronics, food); Classes 35–45 cover services (advertising, education, hospitality, legal services). Your trademark is protected only within the class you register under, so choosing correctly is critical to avoiding both rejection and gaps in protection.
Class 9
Computer software and electronics.
Class 25
Clothing.
Class 35
Business management and advertising.
Class 41
Education and entertainment.

Trademark Registration Process: Step by Step
Trademark availability search — check whether your mark, or anything confusingly similar, already exists.
Select the correct trademark class based on the goods or services you offer.
Prepare documentation — identity proof, address proof, business registration and logo representation, if applicable.
File Form TM-A with the Trademark Registry, along with the applicable government fee. You'll receive an application acknowledgment number.
Examination by the Registrar — your application is reviewed for distinctiveness and conflict with existing marks.
Respond to any objection within 30 days, with legal reasoning and supporting evidence. A show cause hearing may follow if objections persist.
Publication in the Trademark Journal, opening a 4-month public opposition window.
If opposed, file a counter-statement within 2 months and defend your mark before the Registrar.
If unopposed, or if you win the opposition, you receive your Certificate of Registration and can use the ® symbol.
Total timeline: typically 12–18 months from filing to certificate, though the ™ symbol is usable from day one.

Handling Objections and Opposition
Trademark Objection
The Registrar may object to your application under Section 9 (absolute grounds — the mark is generic or lacks distinctiveness) or Section 11 (relative grounds — conflict with an existing mark). You have 30 days to respond with legal arguments and supporting evidence; persistent objections may require a hearing before the Registrar.
Trademark Opposition
After journal publication, any third party has 4 months to oppose your mark if they believe it conflicts with their rights. You must file a counter-statement within 2 months of receiving the opposition notice, after which both sides submit evidence and the Registrar decides.
Mark Bureau manages both objection responses and opposition proceedings on your behalf — from drafting arguments to representing you at hearings.

The complete process typically takes 12 to 18 months from filing to certificate issuance, though you can use the ™ symbol immediately after filing. Expedited examination can shorten the timeline for an additional fee.

™ can be used the moment you file, regardless of registration status, and simply signals a claim to the mark. ® can only be used once registration is officially granted, and using it beforehand is a legal offence.
It's strongly recommended, though not legally mandatory. A thorough search identifies conflicting marks in advance, significantly reducing the risk of objection or opposition later in the process.
